User agrees to indemnify, hold harmless and defend sprinthub.in, its officers, directors, employees, authorized representatives, agents, licensors, suppliers and any third party information providers to the Service provided from and against all losses, costs, expenses, and damages, including reasonable professional fees, resulting from any violation of this Agreement which includes any negligent or wrongful conduct by user or any other person accessing the Service.
The provisions of paragraphs Use of the Service and Indemnification are for the benefit of sprinthub.in and its officers, directors, authorized representatives, employees, agents, licensors, suppliers, and any third party information providers to the Service provided. Each of these individuals or entities mentioned herein above shall have the right to assert and enforce those provisions directly against user on its own behalf.
This Agreement shall be governed and construed in accordance with the laws of Rajasthan and India applicable to agreements made and to be performed in any part of India. User agrees that any legal action or proceeding between sprinthub.in and user for any purpose concerning this Agreement or the parties’ obligations hereunder shall be brought exclusively in competent jurisdiction of state court sitting in India. User can claim any action with respect to the Service availed must be commenced within one (1) year after the claim or cause of action arises or such claim or cause of action is barred. sprinthub.in’s failure to enforce strict performance or insist upon of any provision of this Agreement shall not be considered as a waiver of any provision or right. sprinthub.in may assign its rights and duties under this Agreement to any party at any time without notice being issued to the user.
Any rights not expressly granted herein are reserved.
